Your privacy is critically important to us

OuterSpatial is built and maintained by Trailhead Labs. This privacy policy is cross-posted here for convenient reference from the Trailhead Labs website.

At Trailhead Labs, we have a few fundamental principles:

  • We don’t ask you for personal information unless we truly need it. (We can’t stand services that ask you for things like your gender or income level for no apparent reason.)
  • We don’t share your personal information with anyone except to comply with the law, develop our products, or protect our rights.We don’t store personal information on our servers unless required for the ongoing operation of one of our services.
  • We aim to make it as simple as possible for you to control what’s visible to the public, seen by search engines, kept private, and permanently deleted.

Trailhead Labs, Inc. (“Trailhead Labs”) operates multiple websites — including trailheadlabs.com and outerspatial.com — and mobile applications — including Daycation, OuterSpatial, and branded mobile applications built on the OuterSpatial platform. It’s Trailhead Labs’ policy to respect your privacy regarding any information we may collect while using our websites and/or our mobile applications.

Visitors to Our Website and Mobile Applications

Like most website and mobile application operators, Trailhead Labs collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. Trailhead Labs’ purpose in collecting non-personally identifying information is to better understand how Trailhead Labs’ visitors use its websites and mobile applications. Trailhead Labs may release non-personally-identifying information in the aggregate (e.g., by publishing a report on trends in the usage of its websites or mobile applications).Trailhead Labs also collects potentially personally-identifying information like Internet Protocol (IP) addresses for logged in users and for users leaving comments on our websites and mobile applications. Trailhead Labs only discloses logged in user and commenter IP addresses under the same circumstances that it uses and discloses personally-identifying information as described below, except that commenter IP addresses and email addresses are visible and disclosed to the administrators of the product where the comment was left.

Real-time Location Information

When you use our mobile applications, we use GPS (or other similar) technology to determine the current location of the device being used to access the application in order to determine where it's located and display relevant information. We also collect non-personally-identifying data about the device location and use it to improve our maps.If you do not want us to use the location of the device for the purposes set forth above, you should turn off location services for the mobile application in the device's settings and/or within the mobile application's settings.

Gathering of Personally-identifying Information

Certain visitors to Trailhead Labs’ websites and mobile applications choose to interact with Trailhead Labs in ways that require Trailhead Labs to gather personally-identifying information. The amount and type of information that Trailhead Labs gathers depends on the nature of the interaction. For example, we ask visitors who sign up for an OuterSpatial account to provide an email address. Those who engage in transactions with Trailhead Labs — by purchasing access to the OuterSpatial platform, for example — are asked to provide additional information, including, as necessary, the personal and financial information required to process those transactions. In each case, Trailhead Labs collects such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor’s interaction with Trailhead Labs. Trailhead Labs does not disclose personally-identifying information other than as described below. Visitors can always refuse to supply personally-identifying information, with the caveat that it may prevent them from engaging in certain activities while using our websites and mobile applications.

Aggregated Statistics

Trailhead Labs may collect statistics about the behavior of visitors to its websites and mobile applications. For instance, Trailhead Labs may monitor the most popular trails in the OuterSpatial platform and display this information publicly or provide it to others. However, Trailhead Labs does not disclose personally-identifying information other than as described below.

Protection of Certain Personally-identifying Information

Trailhead Labs discloses potentially personally-identifying and personally-identifying information only to its employees, contractors, and affiliated organizations that (i) need to know that information in order to process it on Trailhead Labs’ behalf or to provide services available at Trailhead Labs’ websites and mobile applications and (ii) that have agreed not to disclose it to others. Some of those employees, contractors, and affiliated organizations may be located outside of your home country; by using Trailhead Labs’ websites and mobile applications, you consent to the transfer of such information to them. Trailhead Labs will not rent or sell potentially personally-identifying and personally-identifying information to anyone. Other than to its employees, contractors, and affiliated organizations (as described above), Trailhead Labs discloses potentially personally-identifying and personally-identifying information only in response to a subpoena, court order or other governmental request, or when Trailhead Labs believes, in good faith, that disclosure is reasonably necessary to protect the property or rights of Trailhead Labs, third parties, or the public at large. If you are a registered user of a Trailhead Labs website or mobile application and have supplied your email address, Trailhead Labs may occasionally send you an email to tell you about new features, solicit your feedback, or just keep you up to date with what’s going on with Trailhead Labs and our products. We primarily use our social media accounts and product blogs to communicate this type of information, so we expect to keep this type of email to a minimum. If you send us a request (via one of our social media accounts, a support email, or one of our feedback mechanisms), we reserve the right to publish it in order to help us clarify or respond to your request or to help us support other users. Trailhead Labs takes all measures reasonably necessary to protect against the unauthorized access, use, alteration, or destruction of potentially personally-identifying and personally-identifying information.

Cookies

A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. Trailhead Labs uses cookies to help Trailhead Labs identify and track visitors, their usage of Trailhead Labs’ websites, and their website access preferences. Trailhead Labs visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using Trailhead Labs’ websites, with the drawback that certain features of Trailhead Labs’ websites may not function properly without the aid of cookies.

Business Transfers

If Trailhead Labs, or substantially all of its assets, were acquired, or in the unlikely event that Trailhead Labs goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of Trailhead Labs may continue to use your personal information as set forth in this policy.

Children

Unless stated otherwise for a specific service or platform, children are not allowed to use the Trailhead Labs websites, apps, or platforms, and we do not knowingly collect personal information from them. We define a “Child” as anyone under 13 years old.

For services or platforms that do permit Child participation, parents or legal guardians (“Parent”) must provide verified consent. Verifiable parental consent is required for the collection, use, or disclosure of a Child’s personal information. Trailhead Labs will not collect, use, or disclose any personal information from a Child if their Parent does not provide such consent. Trailhead Labs may ask a Child to provide contact information, such as an email address, for a Parent in order to request consent for the Child to use the platform or service.

Parents have the right to review their Child’s personal information, to have their Child’s personal information deleted, and to refuse further collection, use, and/or disclosure of their Child’s personal information by notifying us. As a parent, you understand that Trailhead Labs has a legitimate interest in providing your Child’s personal information collected via Trailhead Labs’ platforms or services to external providers for the sole purpose of administering or providing the platforms or services, as described elsewhere in this Privacy Policy.

If we learn that we have collected personal information of a Child, and we do not have parental consent, we will take steps to delete such information from our files as soon as possible.
